How to Gift a Car in Oklahoma
Last verified: October 2026 against Service Oklahoma sources
Oklahoma exempts a gift between spouses, or between a parent or stepparent and a child or stepchild, from excise tax with Form 794. Siblings and grandparents do not qualify.
Here is how to transfer a gifted car.
Step by step
- 1
Check that the transfer qualifies
The family exemption covers transfers between spouses and between a parent or stepparent and a child or stepchild. It does not cover siblings, grandparents, or other relatives.
- 2
Make sure it is a gift
The vehicle must be given, not sold. If anything of value is exchanged, the exemption does not apply.
- 3
Complete Form 794
The giver, as the registered owner on the title, completes Form 794, the Family Affidavit, with supporting documentation. It goes in with the title.
- 4
Transfer the title
Bring the assigned, notarized title (or Form 718 for an electronic title), your driver’s license, and proof of Oklahoma insurance to Service Oklahoma or a licensed operator.
- 5
Pay the title fees
Title fees of $29.50 and registration still apply.
Other excise tax exemptions
- Divorce: a transfer to either former spouse under a divorce decree that names the spouse and includes the VIN
- Dropping a name from a title (adding a name is taxed unless another exemption applies)
- Transfers between a trust and its trustee
